In a historic trial, the Supreme Court (SC) ruled on Thursday that gay consensual gay sex is not a crime that says that sexual orientation is natural and that people have no control over it.
The ruling, issued by a court of the Constitution of the country’s high court, has violated Section 377 of the British Penal Code (CPI) of the British era, which considered gay sex a punishable offense. Now, it is no longer a crime under Section 377 to engage in consensual gay sex in private.
In the combined trial, the CJI and Judge Khanwilkar said that the Section would not apply to consensual acts between homosexual, heterosexual, lesbian and other sexual minorities, but would apply to bestiality and sexual acts without the consent of one. from them.
