New Delhi: The Supreme Court has expressed displeasure over the decision of the Kerala government in which it had allowed people to open shops on Eid. The Supreme Court said that he should follow the order given in the Kanwar Yatra. In this, the court had considered the right to health of the people to be paramount. The court said that the right to life cannot be compromised, if something unfortunate happens, then any court can come in public, we will take appropriate action. The Kerala government, in an affidavit filed in the Supreme Court, defended the decision to relax Kovid 19 restrictions on the occasion of Bakrid.
The Kerala government said that this decision was taken to give relief to the businessmen troubled by the economic slowdown. The traders had already deposited the goods for sale on the occasion of Bakrid. Not only this, business organizations were opposing the strict restrictions and threatening that they would defy the rules by opening shops across the state. The opposition parties were also demanding concession in restrictions keeping in view the interest of the businessmen.
The court has not yet quashed the Kerala government’s notification of concession. The court expressed displeasure over the stand of the Kerala government. The Supreme Court said that the response of the Kerala government is sad. The decision of one-day relaxation in Category D is unfortunate. Justice Nariman said that the most worrying thing is that in category D where the Kovid infection was maximum, the Kerala government has given relaxation of one day. This is a matter of concern. According to the affidavit of the Kerala government, he divided the entire state into 4 categories from A to D in view of the Kovid cases. The Kerala government told the court that from June 15, offices and shops had started opening. Based on the assessment of the situation, the exemption is being increased gradually. Ranjit Kumar, appearing for the Kerala government, said that the Kerala government is taking precautions in view of Kovid. Permission has been given to open shops only in those areas where the positivity rate is low.
At the same time, Vikas Singh said that the Kerala government is talking about giving relief to the traders on the occasion of the festival. In this sense, relaxation should be given on Holi and Diwali also. There is no justification for the answer of the Kerala government. In Uttar Pradesh, the positivity rate is .02%, even then there is a ban, in Kerala, it is 10 percent, even then they are talking about the concession.

Kerala government did not cancel the notification of the Kerala government to give exemption on the occasion of Bakrid. Today was the last day of exemption, so the court considered that the time has passed. The court pulled up the Kerala government for the relaxation of restrictions under pressure from businessmen. The Supreme Court said that Fundamental Rights cannot be compromised under any pressure. The court said that the Kerala government should keep in mind our order given in the Kanvad Yatra. In this, the court had declared the right to life under Article 21 as paramount. The Supreme Court said that if something unfortunate happens, a public person can come to the court, we will pass an appropriate order.
